Deed Restrictions & Other Community Regulations
Deed Restrictions and Covenants, Conditions and Restrictions (CC&R’s)
Deed Restrictions are a set of private rules, separate from public laws like zoning, that are written directly into the deed of your property. These rules control what you can and can’t do with your land and home, and they don’t just apply to you, they apply to every single person who owns the property after you.
The Key takeaway:
A deed restriction, also known as a restrictive covenant, is a legally binding condition written into a property's deed that limits the use of that property by current and future owners.
A deed restriction can control everything from the minimum square footage of your home and the color of your front door to whether you can operate a home business or park an RV in your driveway
Deed restrictions are binding to the purchased property regardless of participation or membership in a POA or HOA.
